Glenn Perlow, New Hampshire Trust Council President, noted “SB 435 will provide tangible benefits to settlors and beneficiaries of New Hampshire trusts and further solidify New Hampshire’s standing as a premier estate planning state by: (1) expanding the current menu of estate planning options through the creation of an express unitrust; (2) facilitating the establishment of directed trusts by appropriately limiting the scope of a trustee’s duty to redress a breach of trust by another trustee; and (3) making the State’s trust laws even more accessible and user-friendly by consolidating orphan provisions, clarifying language, and correcting errors. The New Hampshire Trust Council appreciates the broad support it continues to receive in the Legislature for its proposals.”
